Once a product protected of IP right has been marketed either by the IP right owner or by others whit her consent, the IP right owner cannot prohibit the further commercialization (like the resale) of that product. Thus , a critical element in determining that the owner of an IP right has exhausted her/his rights is her/his consent to the product on the market. The above doctrine have different implications depending on whether the country of importation , for reasons of Law or policy , applies the concept of national, regional or international exhaustion. This doctrine is unanimously recognized at a national level. However, the exhaustion of rights remains a matter of each individual jurisdiction.}, keywords = {Consent.,Exclusive,Exhaustion Doctrine,Intellectual Property Rights}, title_fa = {دکترین استیفاء حق در نظام حقوق مالکیت فکری}, abstract_fa = {ایران در آستانه عضویت در سازمان تجارت جهانی قرار دارد، از این رو در فرصتی که تا پیوستن قطعی وجود دارد باید ضمن تامین و تضمین حقوق مالکیت فکری، شرایط تجارت آزاد را فراهم کرده تا در بستر حقوق انحصاری مالکان فکری، مسیر رقابت نیز هموار شود، این مقاله سعی دارد به دکترین استیفاء حق به عنوان راهگشای تنش میان حقوق مالکیت فکری و مالکیت سنتی با نگاهی به تنش این حقوق با تجارت آزاد بپردازد، به عبارتی دیگر حوزه و چشم انداز دکترین را تبین و توضیح داده و شرایط اعمال آن را بررسی می نماید.}, keywords_fa = {انحصار,تجارت آزاد,حق مالکیت,حقوق مالکیت فکری,دکترین استیفاء حق,رضایت.}, url = {https://jlq.ut.ac.ir/article_27079.html}, eprint = {https://jlq.ut.ac.ir/article_27079_863c38957f7ec9cb41c040177d8dbd31.pdf} }
