While they used to have a lesser role in the past centuries, this role was not totally marginal either. Most Imami jurists reject deeds as evidence and have questioned their validity on various bases including the exclusivity of the valid types of evidence specified in the Sources, the possibility of frauds and impossibility of the intentions being embodied in writings. A glance at the history of deeds reveals however that they were used for specific purposes in any particular era. They were often produced by the parties to transactions and were often accepted by the courts. There were official jobs associated with scribing and preparing deeds. Moreover, Quran has commanded Muslims to write down their contracts. This study aims to renounce the notion that the deeds were regarded invalid as evidence, and to demonstrate that it was only the lifestyle of the past generations that made their employment difficult and that from the legal point of view, there is no caveat to the validity of the deeds.}, keywords = {Keywords: Document,Validity,Evidence,Written Evidence.‎}, title_fa = {واکاوی تاریخی کارکرد اسناد و حجیت فقهی سند در دعاوی ‏}, abstract_fa = {     اهمیت سند و حجیت آن در عصر کنونی در امور قضایی و غیرقضایی بر کسی پوشیده نیست. در اعصار گذشته سند کاربرد امروزه را نداشته است، اما در عین حال این‌گونه نیز نبوده که کاملاً مورد غفلت واقع شده باشد. مشهور فقهای امامیه سند را به‌عنوان یکی از ادلۀ اثبات دعوا شناسایی نکرده‌ و به دلایل مختلف از جمله حصری بودن دلایل اثبات دعوا در موارد مشخص، احتمال تزویر در اسناد و عدم امکان انشای معاملات از طریق کتابت، حجیت آن را مورد تردید قرار داده‌اند. نگاهی گذرا در تاریخ آشکار می‌سازد که اسناد در هر عصر و زمانی کاربرد خود را داشته است. اشخاص در معاملات خود به تنظیم سند مبادرت می‌ورزیدند و محاکم نیز تا حدود زیادی این اسناد را مورد پذیرش قرار می‌دادند و حتی مشاغلی رسمی در خصوص نوشتن سند و تنظیم اسناد وجود داشته است. از طرف دیگر، قرآن کریم نیز مؤمنان را امر به نوشتن معاملات مدت‌دار خود کرده است. این پژوهش در پی آن است که با بررسی فقهی- تاریخی نشان دهد که این‌گونه نبوده که اسناد به‌واقع حجیت نداشته باشد، بلکه شرایط و سبک زندگی گذشتگان عمل به مفاد آن را دشوار ساخته بوده است و از نظر فقهی هیچ مانعی بر سر راه حجیت سند وجود ندارد.}, keywords_fa = {‎ ‎‏ ادله اثبات,بینه,حجیت,سند,کتابت.‏}, url = {https://jlq.ut.ac.ir/article_83669.html}, eprint = {https://jlq.ut.ac.ir/article_83669_9a79e31e902e1cc2a4fadc3b8dd9a126.pdf} }
