One of the most important crimes that, considerably, its manner of commitment has been complicated and various is “ espionage “ and its related crimes. One of the approximate new methods that enemies have employed for gathering the information against Islamic Republic is named “elicitation“. For increasing the use of this method, legislator concerned about it and in 1375, for increasing the care and attention of governmental official in protection of the classified information, considered their negligence in this area as “ elicitation “ crime. But the way of writing and arranging the statute cause some difficulties and ambiguities. In this paper, we refer to the history of the subject and define the crime and analyse its relative legal rules. پیشرفت های علمی، تمامی زوایای زندگی بشر از جمله کیفیت ارتکاب جرائم را تحت تاثیر قرار داده و متحول ساخته است. از مهم ترین جرائمی که کیفیت ارتکاب آنها با پیشرفت علم به شکل قابل توجه متنوع و پیچیده شده، جاسوسی و جرائم مرتبط با آن است. یکی از شیوه های جدید مورد استفاد? دشمن برای جمع آوری اطلاعات از جمهوری اسلامی، روش تخلی? اطلاعاتی است. به دنبال افزایش میزان بهره برداری از شیو? مزبور، قانون گذار در سال 1375 به منظور بالا بردن میزان دقت ماموران دولتی در حفظ و نگهداری اسرار نظام، بی مبالاتی آنان را در زمین? حفظ اطلاعات طبقه بندی شده تحت عنوان تخلی? اطلاعاتی جرم انگاری کرد. لیکن نحو? نگارش ماد? قانونی ذی ربط، ابهامات و اشکالاتی را به وجود آورده است. https://jlq.ut.ac.ir/article_21607_24e1d009c976281f503fbced77fe322a.pdf
