دانشگاه تهران مطالعات حقوق خصوصی 2588-5618 38 2 2008 06 21 THE DIFFERENT PETROLEUM CONTRACTS, THE EVOLUTION OF THE CONTRACT TOWARDS THE COOPERATIVE CONTRACTS انواع قراردادهای نفتی "تحول قراردادهای نفتی از قراردادهای معاوضی به سوی قراردادهای مشارکتی" 27076 FA فرهاد ایرانپور Journal Article The analyze of petroleum contracts demonstrate that in respect to the intensity of the cooperation between the state company and oil companies, we could find the different evaluative categories of the contracts on upstream oil industry.Historically, the first generation of the petroleum contracts was the Concession Agreement in which the transferring of ownership was the base. The License Agreement as a contract for transfer of the oil benefit was another category of the contract in the oil industry. In the historical evolution of the petroleum contracts, we realize the creation of the Service Contract which is, in fact, the result of national revolution in the oil countries. And actually, the sharing concept is replaced to the reciprocal concept in the petroleum contract and now the Production Sharing Agreement is a predominant model in the oil industry in developing countries. مطالعه قراردادهای نفتی نشان دهنده آن است که با توجه به میزان و نحوه مداخله شرکت سرمایه گذار نفتی، دولت و یا شرکت دولتی میزبان در قراردادهای اکتشاف، توسعه و استخراج نفت، با تنوع و تحول شگرفی مواجه هستیم. تحولی که شروع آن از انتقال مالکیت عین در "قراردادهای امتیازی" (Concession Agreement) آغاز و در ادامه به انتقال مالکیت منفعت در قراردادهای موسوم به "قراردادهای اجازه بهره برداری".(License Agreement) منجر و در سیر تحولی خود و تحت تاثیر جنبش های ملی به قراردادهای تداینی به عنوان "قراردادهای خدماتی" (Service Agreement) نزدیک می گردد. در ادامه این روند تکاملی، مفهوم مشارکت، جایگزین رابطه معاوضی و مغابنه‌ای صرف می شود و راه کار قراردادی منبعث از مشارکت در تولید (Production Sharing Agreement) به عنوان مبنای بسیاری از قراردادهای نفتی در کشورهای در حال توسعه شکل می گیرد. https://jlq.ut.ac.ir/article_27076_9421c38d86e75f5851f5241770f86142.pdf
