With due respect to the special<br />position of States in international law, it is importance to examine their<br />obligations regarding the right to food. The principal question is that what<br />constitutes the legal basis of such obligations. In this paper, it is<br />demonstrated that the legal basis of these obligations originates from the<br />international documents on human rights, particularly, the UN Covenant on<br />Economic, Social, and Cultural Rights. In addition, this paper examines the<br />most important mechanisms for realization the right to food, including<br />designing national strategies, legislating and providing legal ways to<br />guarantee the right to food. This paper concludes that if the right to food is to<br />be fulfilled, States should observe their obligations nationally and<br />internationally. <em>در چارچوب حقوق بین‌الملل، حق بر غذا، حق بنیادین هر شخص بر دسترسی پایدار به غذا به‌گونه‌ای‌ست که پاسخگوی نیازهای غذایی وی باشد. با توجه به جایگاه ویژه‌ دولت‌ها در حقوق بین‌الملل، بررسی تأمین حق بر غذا به عنوان یکی از تعهدات دولت‌ها از اهمیت خاصی برخوردار است. پرسش اصلی آن است که اساس حقوقی تعهدات دولت‌ها در زمینه حق بر غذا چیست و چگونه باید به این تعهد عمل کنند. در این مقاله نشان داده ‌می‌شود که مبنای حقوقی تعهد دولت‌ها نسبت به حق بر غذای کافی برگرفته از اسناد بین‌المللی حقوق بشری به ویژه میثاق بین‏المللی حقوق‏ اقتصادی، اجتماعی و فرهنگی­ست. همچنین در این مقاله بیان می‌شود که مهم‌ترین روش‌های تحقق حق بر غذا، تدوین استراتژی‌های ملی، قانون‌گذاری و اقامه‏پذیری حق بر غذا می‌باشند. نهایتاً نتیجه‌گیری می‌شود که برای تحقق حق بر غذا، دولت‌ها باید به تعهدات خود در سطوح ملی و بین‌المللی عمل کنند.</em> https://jlq.ut.ac.ir/article_35273_f8b7cfae139c5cac77924665aa70e030.pdf
