تحلیل موضع نظام حقوقی ایران در قبال رادیو و تلویزیون خصوصی و چالش‌های فرا راه آن

چکیده

تأسیس و راه‌اندازی رادیو و تلویزیون خصوصی و امکان فعالیت آن در کنار رادیو و تلویزیون دولتی، شیوۀ برگزیدۀ ادارۀ رادیو و تلویزیون در بسیاری از کشورهای جهان امروز است. در نظام حقوقی ایران، با توجه به دولتی عنوان شدن صدا و سیما در اصل چهل و چهارم قانون اساسی و تفسیر مضیق شورای نگهبان از اصل یادشده، تأسیس رادیو و تلویزیون خصوصی همواره با چالش‌ها و مخالفت‌های بسیاری روبه‌رو بوده است. تحلیل موضع قانون اساسی و مرجع تفسیر آن و راهکار‌های برون‌رفت از چالش‌های مطرح‌شده، از ضرورت‌های نظام حقوقی ایران است. افزون‌براین، قوانین مصوب مجلس شورای اسلامی از این نظر که سازوکارهای تمرکزگرایی رسانه‌ای در رادیو و تلویزیون را تقویت نموده و از ضرورت حضور بخش خصوصی در این رسانۀ فراگیر حمایت نکرده است، باید بررسی گردد.

چکیده [English]

Establishing and operating private Radio and Television and its possible activity beside State Radio and Television is the selective method of administering Radio and Television in many Countries worldwide. In legal System of Iran, State Run Radio and Television in Article 44 of the Constitution and Interpretation of Guardian Council of mentioned Article, establishing Private Radio and Television encounter with many disagreements and barriers. Analysis of position of Constitution and its official Interpret and Solutions for getting Rid of mentioned challenges are one of the necessary points of Iranian Legal System. In addition, the Rules passed by Islamic House of Representatives which enhance the concentration of in Radio and Television and in which the necessity of privatization is not concerned, should be taken into consideration.
