The exclusive patent rights of Standard Essential Patent (SEP) holders have been shown to create obstacles for standard implementers in accessing patented new technologies set as a standard. FRAND contracts in Standard Setting Organizations (SSOs)' IPR policies are designed to prevent the patent hold-up without providing aa precise definition of its legal nature. In several jurisdictions, judges have different perspectives on the legal nature of FRAND with two approaches generally being taken. In the U.S, most courts have adopted the contractual approach, while in other jurisdictions, a different approach is adopted, not considering FRAND as a binding contract. This library-based research and comparative study considers that the contractual approach to FRAND is compatible with contract law in the Islamic Republic of Iran.
