بررسی مقررات بخش کشاورزی ایران در پرتو موافقت نامه کشاورزی سازمان جهانی تجارت

چکیده

هر کشوری که خواهان عضویت در سازمان جهانی تجارت (WTO) است، باید مجموعه قوانین داخلی خود را با اصول و موافقت­نامه­های این سازمان هماهنگ کند. کشاورزی یکی از بخش­هایی است که باید با اصول سازمان مذکور همسو باشد. به این موضوع، در مذاکرات «دور اروگوئه» در قالب «موافقت نامه کشاورزی» پرداخته شد. کشور ایران در بخش کشاورزی نیز، باید قوانین خود را با مقررات سازمان جهانی تجارت و این موافقت نامه هماهنگ کند. به همین جهت، در این مقاله، که برای رفع خلا  ادبیات حقوقی کشور در این زمینه ارائه گردیده است، در فصل اول به بررسی سیر تاریخی موافقت نامه، در فصل دوم به تشریح اصول اساسی موافقت­نامه و سازمان جهانی تجارت می­پردازیم، آنگاه در فصل بعد، اقدام به بررسی اهم قوانین مغایر ایران در بخش کشاورزی کرده و در پایان، ضمن بر شمردن قوانین مغایر، راهکارهای پیشنهادی خود را به قانون گذار ارائه می­دهیم.

چکیده [English]

Each country who wants to access the world Trade Organization have to
correspond their regulation with WTO principles. One of the areas where
rules uniformity must be done, is in the agricultural section. This subject is
reviewed, In Uruguay Round as Agricultural Agreement. Iran must
coordinate its regulation in agricultural part with World Trade Organization
and its agreement regulations. However, Because this important issue has
not been studied in Iranian legal literature, In The first chapter, we examine
the history of Agreement and in the second chapter describe the basic
principles of the agreement and WTO, Then in the next chapter I will
attempt to review agricultural Iranian laws contrasts against the agreement
And in the last chapter in addition to Enumerate rules contrasts, Offer our
Proposed solutions to the legislators.
