ویژگی‌های قواعد شکلی (آیین دادرسی مدنی)

چکیده
    هرچند به ظاهر مفهوم قواعد شکلی امری بدیهی به‌نظر می‌رسد، برخلاف این ظاهر می‌توان گفت هنوز ماهیت، ویژگی‌ها و کارکردهای این قواعد آنچنان که شایسته است، تحلیل نشده و به‌راستی مفهوم و ویژگی‌های این قواعد مورد سؤال است. از فلاسفۀ بسیار قدیمی می‌توان بنتام را نام برد که به تبیین مفهوم قواعد شکلی پرداخته است و از نظر وی قواعد شکلی وسیلۀ اجرای حق‌های ماهوی هستند. قواعد شکلی هم از حیث اهداف و هم از حیث ویژگی‌ها و همچنین از حیث کارکردها از قواعد ماهوی‌ متفاوت‌اند. این قواعد ابزار اعمال حاکمیت‌اند؛ ابزار تأمین حق‌های شکلی‌اند؛ حالتی انتخابی دارند؛ بر قواعد ماهوی تفوق دارند؛ عوام‌فهم نیستند و به شیوه‌هایی خاص بین حق‌های شخصی و حاکمیت هارمونی برقرار می‌کنند و نظم را در بین خود مردم و همچنین بین دولت و مردم برقرار می‌سازند.

چکیده English

The concept of procedural rules apparently is obvious, but, you can say, features of procedural rules not analyzed properly. Indeed, the nature of these rules is questioned. Bentham as one of very old philosophers has defined the concept of procedural rules. In his view, procedural rules are the means of enforcing substantive rules. Procedural rules in goals, features, and functions are different from the substantive rules. These rules are the means of applying sovereignty, serving procedural rights. They are voluntary, supremacy on substantive rules, and technical concepts. With special ways they are harmonized between personal rights and sovereignty, and do order between people themselves as well as people with sovereignty.
