محدودیت‌های نظام‌های سنتی حقوق مالکیت فکری در حمایت از طرح‌های مد و لباس

چکیده

     حقوق مالکیت فکری به صورت سنتی بر بنیان‌های حمایت از اختراعات (پتنت)، مالکیت ادبی- هنری (کپی‌رایت)، و علائم (علامت تجاری) استوار شده و حقوق ویژۀ مالکیت فکری، نظیر حقوق طرح‌ها، خارج از این چارچوب و نیز دائماً مورد پرسش و صورت‌بندی مجدد است. در صنعت مد و لباس که صنعتی با مالکیت فکری بالاست، به‌طور دائم ایده‌ها و نوآوری‌های خلاقانه تولید و از آن‌ها بهره‌برداری تجاری می‌‌شود‌، اما این پرسش که آیا طراحان مد و لباس می‌توانند از آثار خود در چارچوب حقوق مالکیت فکری کشورشان حمایت کنند یا نه، همواره موضوع بحث‌های جدی بوده است. برخلاف صنایعی نظیر موسیقی، فیلم، بازی‌های ویدئویی و نشر کتاب، عنصر اصلی و اساسی صنعت مد و لباس- طرح‌های مد و لباس- به صورت کامل در حمایت حقوق سنتی مالکیت فکری نیست؛ بنابراین یک حقوقْ ویژۀ مالکیت فکری برای حمایت از طراحان تأسیس شده است.

چکیده [English]

Intellectual property law is premised traditionally on the protection of inventions (patent), literary and artistic property (copyright), and signs (trade mark); and Sui generis rights, such as design law, stand outside this framework and are constantly questioned and re-shaped the fashion industry is an intellectual Property (iP) intensive industry, continually generating and commercially exploiting creative ideas and innovations, but the question of whether fashion designers can protect their works under the intellectual property laws of their country is hotly debated. Unlike the industries like music, film, video game, and book publishing, the fashion industry’s principal creative element— its apparel designs— doesn’t protect by traditional IPR completely and hence it’s created a sui generis IPR for protection of designers.
